THE CONSTITUTION OF

THE KINGDOM OF COLONIA

INVOKING THE GRACE AND POWER OF THE ALMIGHTY, IN WHOSE HANDS REST THE DESTINY OF MEN AND NATIONS, AND BY VIRTUE AND IN THE LEGITIMATE EXERCISE OF THE RIGHTS AND PROROGATIVES OF POSSESSION, DOMINION AND SOVEREIGNTY ACQUIRED THROUGH DISCOVERY AND OCCUPATION, OF THE FORMER FREE TERRITORY OF FREEDOM LAND WHICH HAS NOW BEEN RENAMED COLONIA WITH THE STATUS OF KINGDOM FROM THE FOURTH OF AUGUST NINETEEN HUNDRED AND SEVENTY FOUR. THIS CONSTITUTION CREATES AND ESTABLISHES THE SOVEREIGN GOVERNMENT FOR THE WHOLE ARCHIPELAGO OF THE KINGDOM OF COLONIA DE FACTO IN NATURE IN ORDER TO PROMOTE GENERAL WELFARE AND THE IDEALS OF LIBERTY JUSTICE AND PEACE IN THE GREAT SOCIETY OF NATIONS

ARTICLE I

THE NATIONAL TERRITORY

The National Territory comprises of all the islands, islets, isles, atolls, banks, reefs, shoals, fishing grounds and waters, more particularly bounded as follows:

And all other territories belonging to the Kingdom of Colonia by historic or legal title including the territorial sea, the air space, the sea bed, and other submarine areas over which this Kingdom has Sovereignty or jurisdiction.

ARTICLE II

Section I.Colonia is a Constitutional Monarchy. Sovereignty resides in the King, advised by the State Council, and all government authority emanates from him for and on behalf of the people.
Section II. Colonia renounces war completely and adopts International Neutrality as its policy together with the accepted principles of International Law as the law of the Country.
Section III. In the exercise of sovereignty the King and Government of Colonia shall be guided by the Universal Declaration of Human Rights as embodied in the Charter of the United Nations.
Section IV.The defence of the State is a first duty of the King. Government and people and in fulfilment of this duty all citizens may be required to render personal military service.
Section V. The State shall establish and maintain social services in the field of health, housing, social security and employment to guarantee a good standard of living for all of the people.

ARTICLE III

CITIZENSHIP

i.Those who are citizens of Colonia at the time of the adoption of this Constitution.
ii.Those born in Colonia or in the same territory previously called Freedomland.
iii.Those whose mothers or fathers; are citizens of Colonia.
iv.Those who were granted citizenship in the Principality or Free Territory of Freedomland since 15th May 1956.
v.Those who are granted citizenship in accordance with law.

ARTICLE IV

BILL OF RIGHTS

i.No person shall be deprived of life, liberty or property without due process of law nor shall any person be denied the equal protection of the laws.
ii.The laws of the United Kingdom of Great Britain as enacted till the year nineteen hundred and forty four are hereby incorporated as the law of the land subject only to
iii.Free access to any court in the land is the right of every person.
iv.All forms of taxation are herewith stated to be illegal.

ARTICLE V

DUTIES AND OBLIGATIONS OF CITIZENS

The duty of every citizen is to give allegiance and be loyal to his King and Country and to honour the Colonian flag, to defend the State, contribute to its development, uphold the Constitution and obey the law.

ARTICLE VI

THE KING

Sec. I.The Principal organ of the Government of the Kingdom of Colonia shall be the Head of State otherwise known as the King of Colonia and President of the Supreme Council of State acting on behalf of his subjects.
Sec. II. The King shall appoint all members of the Supreme Council, Ministers and Commissioned Officers in the Security Forces.
Sec. III. The King only may grant titles by letterai patente, orders and awards for meritorious conduct.
Sec. IV.The King shall be Supreme Commander in Chief of all the Security Forces of Colonia.
Sec. V. The King's successor must come from the Blood Royal that is of the House of Mariveles in direct line. Should the Successor be less than twenty-five years old, incapacitated, or otherwise unable to conduct the duties of the King to protect the Realm and the Constitution: The Secretary General is authorized to act as Regent. In the event there is no Successor in the direct line, the Secretary General shall nominate a Successor for approval by the State Council.

ARTICLE VII

SUPREME COUNCIL OF STATE

The King will be advised for consent on all matters by a State Council to be composed of at least five (5) permanent Members as established and constituted by virtue of Agreements and Appointments made by the former Head of State, Tomas Cloma, and the former Supreme Council of both the Principality of Freedomland and the Free Territory of Freedomland, which has been elevated and renamed Kingdom of Colonia prior to the accession to the throne of our present King.  The King and the Secretary General shall be permanent members.

Functions and Powers

Section I.The primary responsibility of the Council shall be to administer the Government.
Section II. The Supreme Council may establish and designate as such, institutions of the KINGDOM in addition to those specified in Article V of this Amendment, for the achievement of the objectives of the KINGDOM.
Section III. The Supreme Council will issue directions of a general or special character as to the policy to be pursued by the Institutions of the KINGDOM for the achievement of the objectives of the KINGDOM, and effect shall be given to any such direction.
Section IV.The Council shall take decisions for the purpose of establishing the financial arrangements necessary for meeting the expenses of the KINGDOM, on behalf of the KING who shall be the final authority on questions arising in relation to the financial affairs of the KINGDOM.
Section V. The Council may regulate its own procedures and may decide to admit at its deliberations observers, representatives of states or other entities.
Section VI. The Council may consult with entities and other organisations within the region and for this purpose may establish such machinery as it deems necessary as permitted by the KING.

The members of the Supreme Council on assuming office shall take the following oath: –

I do solemnly swear that I will support and defend the Constitution of the Kingdom of Colonia; that I will bear true faith and allegiance to His Majesty The King at all times and under all circumstances; that I will at all times obey the legal orders of the legal authorities; that I will execute its laws, do justice to every man and consecrate myself to the nation. I take this obligation freely and without any mental reservation or purpose of evasion. SO HELP ME GOD. (In case of affirmation, the last sentence will be omitted).

ARTICLE VIII

INSTITUTIONS OF THE KINGDOM

Institutions of the Kingdom shall be:

a. The Standing Committee and Minister responsible for Foreign Affairs;
b.The Standing Committee and Minister responsible for Justice;
c.The Standing Committee and Chancellor shall be Minister responsible for the Treasury and Finance.
d. The Standing Committee and Minister responsible for Internal Affair: and general day to day government of the islands Amboyna, Mariveles, Commodore and Alicia Annie and all other
e.The Standing Committee and Minister responsible for Agriculture and Fisheries;
f.The Standing Committee and Minister responsible for Postal Matters and Communications;
g. The Standing Committee and Minister responsible for Mines, Natural Resources and Labour;
h.The Standing Committee and Minister responsible for any other institution that may be established and designated as such by the Council in accordance with Article VII.

The members of the Supreme Council on assuming office shall take the following oath: –

I do solemnly swear that I will support and defend the Constitution of the Kingdom of Colonia; that I will bear true faith and allegiance to His Majesty The King at all times and under all circumstances; that I will at all times obey the legal orders of the legal authorities; that I will execute its laws, do justice to every man and consecrate myself to the nation. I take this obligation freely and without any mental reservation or purpose of evasion. SO HELP ME GOD. (In case of affirmation, the last sentence will be omitted).

ARTICLE IX

THE KINGDOM SECRETARIAT

IThe KINGDOM SECRETARIAT (hereinafter referred to as the "Secretariat") shall be the principal administrative organ of the KINGDOM. The headquarters of the Secretariat shall be located at the seat of government of the KINGDOM, namely the island of Amboyna, without prejudice to the right of the KING to transfer its seat of government to such place as he may deem convenient and appropriate.
IIThe Secretariat shall comprise of a Secretary General and such staff as the Council may require. The Secretary-General shall be appointed by the King for a term not exceeding ten (l0) years and may be reappointed by the KING. He/She shall be the Chief Administrative Officer of the Council and may also hold any other ministerial post.
IIIThe Secretary General shall act in that capacity in all meetings of the Council, if the latter so requires, and of the Institutions of the KINGDOM. The Secretary General shall make an annual report to the Council on the work of the Institutions and of the KINGDOM.

Functions of the Secretariat

The Functions of the Secretariat shall be as follows:

i.To service meetings of the Council and of the Institutions or Standing Committees of the KINGDOM
ii.To take appropriate follow-up actions and decisions made at such meetings, and advise the King accordingly.
iii.To initiate, arrange and carry out studies on questions and matters relating to the achievements of the objectives of the KINGDOM.
iv.To undertake any other duties which may be assigned to it by the Council or any of the Institutions or Standing Committees of the KINGDOM.

ARTICLE X

THE JUDICIARY

Sec. I The judicial power shall be vested in one Supreme Court and such inferior Courts as may be established by law.
Sec. II (a) The Supreme Court shall be composed of three members, one Chief Justice and two associate Justices. It may sit en banc or in two divisions.
Sec. II (b) All cases involving the constitutionality of a treaty or law shall be heard by the Supreme Court en banc.
Sec. II (c) Appeal shall heard by 3 members of the Supreme Court, with Final Appeal to the State Council.
Sec. IIIRules concerning pleading, practice and procedure in all courts and the admission to the practice of law as observed and followed in the United Kingdom of Great Britain prior to 1945 (nineteen hundred and forty five) are hereby made applicable in Colonia unless otherwise repealed, modified and amended by applicable Colonian laws, rules and regulations.
Sec. IVEvery decision of a court shall clearly and distinctly state the facts and law upon which it is Baised.

ARTICLE XI

GENERAL PROVISIONS

Sec. IThe Flag of Colonia shall be a white diagonal cross on a red and blue background surmounted in the centre with the crown of the Royal House as honoured by the people and recognized by law.
Sec. II The Great Seal of the Kingdom of Colonia consists of a circular design on which is inscribed the coat of arms of Colonia. This is a shield bearing in the lower portion a replica of the Flag and in the upper portion, divided into three sections, a sailing ship, a palm tree and three fishes, all representing this Kingdom of Islands. Above the shield is inscribed Kingdom of Colonia surmounted by the Royal Crown supported by two Sea Falcons.
Sec. III The Security Forces of Colonia shall include a citizen army composed of all citizens of Colonia who shall undergo military training as provided by law.....
Sec. IV The State shall maintain full employment for all of its resident citizens.
Sec. V The State shall provide free education for all children to the age of sixteen years.
Sec. VI The official language shall be English other accepted languages shall be Arabic, Chinese
Sec. VII All citizens shall take an Oath to support and defend the Constitution.
Sec. VIII All mass media and telecommunications shall be controlled by the State but any form of censorship is herewith declared illegal.
Sec. IXThe Supreme Council shall establish a central monetary authority which shall provide policy direction in the areas of money, banking and credit. It shall have supervisory authority over all banks, finance companies and other institutions as may be provided by law.
Sec X All land on all the Islands of Colonia is owed by the State. The State may grant leases to Corporations over any land or sea area not exceeding 999 years, or freeholds.
Sec. XI All mineral and fishing rights within the National Territory of Colonia are the property of the State, and the State may grant licenses.
Sec. XII The notices to the world, provisions, proclamations and declarations embodied in a Notice to the World dated May 15th 1956 by the Free Territory of Freedomland, the Declaration of Status of the Free Territory of Freedomland dated 3rd June 1956, the Instrument of Notification of July 6th 1956 and the Proclamation dated July 6th 1956 both of the Free Notification of July 6th 1956 and the Proclamation dated July 6th 1956 both of the Free Territory of Freedomland (one of the former names of this Kingdom) are hereby made part of this Constitution as if such provisions were expressly inserted herein.
Sec. XIII The unit of monetary value in the Kingdom shall be the Colonian Dollar equal in value to the United States of America Dollar and divided into 100 cents. The United States of America Dollar shall also be accepted as legal tender within the Kingdom of Colonia.
Sec. XIV The Kingdom may enter into agreements with States and International organizations.

ARTICLE XII

REGISTRATION

This Constitution shall be registered with the Secretariat of the United Nations.

In witness whereof His Majesty the King of Colonia on behalf of his people has caused the Great Seal of Colonia to be affixed hereto and has signed and set his seal on this 25th day of October 1974, Amboyna, Colonia, with revisions reconfirmed this 29th day of February, 2020, in London, England.
